Service Description
Med-Arb is a comprehensive dispute resolution process designed to fully resolve contested family law matters within a single structured proceeding. Participants first engage in negotiated settlement efforts through mediation and, if issues remain unresolved, those unresolved matters may proceed to binding arbitration for final determination by the same neutral. The Med-Arb process includes up to 14 hours of scheduled proceeding time, which may be allocated as reasonably necessary between mediation efforts, arbitration proceedings, and other dispute resolution services required to bring the matter to final resolution. Med-Arb may be appropriate for divorce, allocation of parental responsibilities, property division, parenting disputes, child support, maintenance, post-decree enforcement or modifications, and other domestic relations matters where participants wish to pursue negotiated settlement while preserving an efficient path to final determination. Med-Arb is conducted by a Colorado attorney serving first as a neutral mediator facilitating settlement discussions and, if necessary, later as a neutral and impartial arbitrator who evaluates unresolved disputes and renders binding decisions.
Scheduling Policy
Submitting a scheduling request does not confirm service. All scheduling requests are subject to conflict screening, administrative review, execution of the required service agreement, and payment of the required scheduling fee. A non-refundable scheduling fee of $500 per Party is required. The scheduling fee is applied toward each Party's total service fee and is earned upon receipt for scheduling coordination, administrative review, and reserving the mediator/arbitrator's availability. Each Party's total service fee is due no later than 14 days before the scheduled service. Once the service is confirmed, rescheduling requests are subject to the arbitrator's determination and may not be eligible for refund. The total service fee includes scheduling coordination, administrative review, reasonable preparation, and the time reserved for the scheduled Med-Arb proceeding. Professional services requiring time beyond the reserved Med-Arb proceeding are billed separately at $500 per hour, allocated equally between the Parties. Additional services may include supplemental drafting services, legal analysis, deliberation, drafting of written findings, issuance of a written arbitration award, or other professional services required to complete the dispute resolution process. Complete terms are provided in the Dispute Resolution Service Agreement. Med-Arb combines mediation and arbitration within a sequential dispute resolution process in which unresolved issues may transition from facilitated negotiation to binding arbitration for final determination by the same neutral. Participation in mediation does not guarantee settlement or resolution of disputed issues. Proceedings are conducted by secure video conference unless alternative arrangements are made in advance. All Parties are generally expected to remain involved throughout the Med-Arb process. Parties represented by legal counsel may have their attorney participate and represent them throughout the Med-Arb process.
